I would wait until 3 days after it has completely healed (as in no red spot, and cold sore is visibly gone) before you kiss him. Herpes is for life, and there's nothing worse than affecting someone who doesn't have it.
No, unfortunately your are not safe when your cold sore has scabbed over. Actually, you are never really safe, but the risk is greatest when you have a visible outbreak. If you use anti viral cream, you are a lot safer. But, talk to your spouse and consider not worying about it, after all, it's just a cold sore, not the plague.
