Unfortunately unless you can obtain his medical records there's not very much that can be done. You first have to prove that this was a known exsiting problem and have hard core "concrete" proof that he knowingly gave this to you. Like a recorded statement of him admitting this, but most likely it would be thrown out in court. It's just very hard to prove unless ( and it far fetched) you can find a few previous people that this person has been intimate with that has contracted the virus. And then again that's another issue finding the people willing to step up to the plate and admit they have it and further more it still must be proven that he was aware he had it.
Very tricky, but its worth it. If the courts has the means to mandate that he be tested and if a court documented can state this in the future you can possibly stop his careless inconsiderate cycle. Hope this can help.
